Biden Admin Forced to HALT Controversial Rule – ICE Given the Green Light!
(ConservativeHub.com) – In the fall of 2021, Homeland Security Secretary Alejandro Mayorkas enacted a new policy stating that Border Patrol agents should only arrest immigrants who directly threaten national security or recently illegally crossed the US border. This modification drastically reduced the number of arrests and deportations by the government, drawing quite a bit of controversy. However, this month, a court ruling forced the Biden administration to nix this policy — at least for now.
On Saturday, June 25, the Department of Homeland Security announced it would follow a court ruling issued by Judge Drew Tipton in the Southern District of Texas that struck down its limited arrest policy. Now, Immigration and Customs Enforcement (ICE) will again instruct its agents to arrest illegal immigrants on a “case-by-case” basis during the appeals process.

Judge Tipton originally paused his order to allow the Department of Justice (DOJ) to appeal to the Fifth Circuit Court. The DOJ requested a suspension of Tipton’s order, but the appellate court hasn’t ruled yet. As of Saturday morning, Tipton raised his pause, putting his order into effect.
With this, ICE agents have much more discretion in deciding which illegal immigrants to seek out, detain, and deport, although they will continue to focus on those who pose the greatest risks to American communities and security.
Officials in Texas and Louisiana originally launched the lawsuit against the Biden administration, and for now, they’ve won. The DHS announced it would comply with the decision while working to appeal it.
