(ConservativeHub.com) – The federal courts continue to serve as a check on President Joe Biden’s effort to impose his will on the states without permission. So far, Texas’ Republican Attorney General Ken Paxton remains undefeated in his work to push back against Biden’s reinvention of immigration policy in line with Democrats’ political aims.
On August 12, US District Judge Drew B. Tipton sided with Texas and Louisiana and granted a request for a preliminary injunction blocking a Biden administration memorandum creating new rules for the US Immigration and Customs Enforcement (ICE) service. Those rules significantly narrowed the categories of undocumented immigrants targeted for arrest and eventual deportation.

Tipton’s 160-page memorandum opinion and order explained portions of Biden’s “Memoranda direct [ICE] to act in a way that is contrary” to the provisions of the Administrative Procedures Act (APA). He also ruled Texas and Louisiana would likely succeed in court with their claim Biden’s directive is “arbitrary” and failed to meet the proper notice and comment procedures required under the APA.
Louisiana Attorney General Jeff Landry praised Judge Tipton’s decision to grant preliminary relief against Biden’s “unlawful attempt to limit deportations.” He also pointed out it was “shameful” a judge had to intercede in the matter. AG Paxton echoed that sentiment, adding it’s high time the federal government woke up and addressed the chaos at the nation’s southern border.
