Judge Pushes Back Against CDC Mask Mandate

(ConservativeHub.com) – A federal judge ruled against the Centers for Disease Control and Prevention (CDC) in a crucial case around face-mask mandates on April 18, according to an AP report.

US District Court Judge Kathryn Kimball Mizelle found the CDC violated regulations for rulemaking and didn’t properly justify its choice to extend its mask mandate for public transportation. She struck down the extension requiring anyone traveling by plane, bus, or other public modes of travel to wear facial coverings until May 3. Companies can now make their own rules.

The Health Freedom Defense Fund brought their objection to the mandate case before Judge Mizelle. In her statement, the judge noted the agency was still obliged to follow the law when putting rules in place even if the CDC had the best intentions with its order.

In a press briefing on April 18, White House Press Secretary Jen Psaki responded to the ruling, saying it was a “disappointing decision.” She noted the CDC continues to recommend wearing masks, and the agency will review the decision. She also explained the Department of Justice will “make any determinations about litigation.”

While the White House will no longer enforce the facial covering order, many transportation authorities maintain their own rules requiring them. Some airlines announced they would drop their own mandates.
