(ConservativeHub.com) – A grand jury indicted former Clinton campaign attorney Michael Sussmann for making false statements to the FBI during the Russian collusion investigation based on a referral by Special Counsel John Durham. In February, Durham made an additional filing in the case, and Sussman’s legal team responded with a motion to toss out the factual background section of Durham’s filing, but the judge said no.
US District Court for the District of Columbia Judge Christopher Cooper made his ruling on March 10, saying the information has already created any effects it will create, so there is no need to remove it from the filing. The team made the request because they felt it might contaminate the jury pool by providing false and misleading information, but Judge Cooper said he saw no reason to strike it.

The factual background section of Durham’s report provides information on how Sussmann ended up speaking with the FBI and allegedly giving false statements. It alleges he worked with a tech executive named Rodney Joffe to gather information from within the Trump campaign and White House to link former President Donald Trump to Russia. The file also contains evidence of Sussmann’s financial records showing he billed the Clinton campaign for his interactions and work with Joffe.
The disgraced attorney’s legal team accused Durham of politicizing the case with the information. Durham objected to the motion, saying everything in his report is factual and imperative to proving the case against Sussmann.
