Court Orders City To Rehire, Pay Workers Fired Over Vaccine

(ConservativeHub.com) – Mandatory vaccinations for COVID-19 have been highly controversial. In New York City, officials issued orders requiring employees to receive the immunization and fired those who refused. A group of sanitation workers took the government to court after they lost their jobs for not taking the injections. A judge sided with the employees, and now the city must pay.

NYC required all workers to have at least the first dose of the COVID-19 vaccine by November 2021. Anyone failing to meet the mandate was subject to losing their jobs. The public health commissioner also issued orders for private companies, requiring immunization by December 2021. The city announced the mandate would drop for private employees on November 1, 2022.

In his ruling, State Supreme Court Justice Ralph Porzio explained the mandates didn’t fall in line with the city’s claims that they were for health and safety. He noted there should have been no exceptions if that was the actual reasoning behind the orders. In addition, he said it wasn’t legal to change the workers’ conditions of employment, and the health commissioner has no authority to fire municipal employers. Porzio ordered NYC to rehire the fired workers and pay them for all lost wages since their terminations.

NYC filed an appeal. A Law Department spokesperson was reported by news outlets saying the vaccine requirement was for public safety and that the city is firmly against the ruling. He also noted the ruling does not remove the mandate, which remains.
