(ConservativeHub.com) – Texas Attorney General Ken Paxton is suing the Biden administration over the new immigration rules as they say that American taxpayers would need to bear the burden of the new system. In the lawsuit filed by Paxton, he points out that according to federal law admission to “illegal aliens” is not allowed if they would need “taxpayer-funded programs” in order to survive within the country.

The new rule, adopted in December 2022, “prevents consideration of statutorily required factors when determining whether an alien is likely to become a ‘public charge.’

A press release points out that immigrants will usually need to provide documentation “of financial support from family” in order to show that they would not be a burden on taxpayers. The release further clarifies that Biden’s rule “prohibits a robust and meaningful investigation into the veracity of this documentation” which according to Attorney General Paxton’s lawsuit is a violation of federal law.

The role which has already gone into effect further notes that the Department of Homeland Security is tasked with determining whether a noncitizen is “likely at any time to become a public charge.” This includes the noncitizen depending on “the government for subsistence, as demonstrated by either the receipt of public cash assistance for income maintenance or long-term institutionalization at government expense.”

Attorney General Paxton has said that the Biden Administration is committed to having open borders which allows the entry of immigrants that are unable to sustain themselves. He added that he would continue to defend the law in order to ensure that immigration does not burden taxpayers any further.
