Judge Rules Against Biden Admin Asylum Policy

(ConservativeHub.com) – On Tuesday, July 25, a federal judge blocked the Biden administration’s rule that would have made any migrants that entered the country illegally unable to apply for asylum while also creating other legal pathways for migrants to enter the U.S.

U.S. District Court for the Northern District of California Judge Jon Tigar has stopped the rule from going into effect following a lawsuit filed by a coalition of immigration advocacy groups. The groups claimed that the rules were very close in nature to the Trump-era transit ban that had also been blocked by the court. According to a Fox News report, Tigar found that the rule was invalid in both its substance and procedure.

The Biden administration was given two weeks to appeal before the ruling goes into effect. The police was created as part of the Biden administration’s efforts to address the expiration of Title 42’s, public health order that allowed for the expulsion of illegal immigrants from 2020 until earlier this year.

The rule states that all immigrants who have illegally entered the U.S. and failed to file asylum claims in one of the countries they passed through while travelling to the U.S. cannot file for asylum here. The administration has said that this rule would push migrants to look into the lawful pathways for receiving asylum instead of using irregular migration. The additional legal pathways created by the administration as part of this plan also include the CBP One app, an app that has enabled migrants to submit an application for over 1,400 appointments available at a port of entry daily so that they can enter the country on patrol.
